Terms of Use

These terms are between you and ELAQ Limited ("we", "us"), which operates Mochibit.

1. Accepting these terms

By downloading or using Mochibit you agree to these terms and to Apple's Licensed Application End User License Agreement. If these terms and Apple's agreement conflict, these terms apply to the extent the law allows.

2. The app

Mochibit is a virtual pet game for iPhone and Apple Watch, with widgets and a Live Activity. We grant you a personal, non-transferable, revocable licence to use it on Apple devices you own or control, as allowed by the App Store's usage rules.

3. Mochibit+ subscriptions and purchases

• Mochibit+ unlocks every species, game and feature listed in the app. It is offered monthly, yearly, or as a one-time lifetime purchase. Prices are shown in the app before you buy and may vary by country.
• Free trial. The yearly plan may start with a free trial. If you do not cancel at least 24 hours before the trial ends, it converts to a paid yearly subscription.
• Renewal. Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the period ends. Payment is charged to your Apple ID.
• Cancelling. Manage or cancel any time in Settings → [your name] → Subscriptions, or from Mochibit → Settings → Manage subscription. Cancelling stops the next renewal; you keep access until the end of the paid period.
• Refunds are handled by Apple under its policies (reportaproblem.apple.com).
• Restore. Use "Restore Purchases" in the app to restore Mochibit+ on a new device with the same Apple ID.

4. Coins and virtual items

Coins and items are a limited licence to use content inside Mochibit. They have no cash value, cannot be exchanged for money, and cannot be transferred or sold. Coins buy specific items; there are no random paid rewards. We may change game balance and items, but we will not remove items you bought with real money without giving you comparable value.

5. Friends and your conduct

You choose your display name and pet names. Do not use names that are offensive, hateful, sexual, impersonate someone, or share personal information. Do not harass other players. We filter names, and you can report or block any player in the app. We may hide names, remove friend profiles, or restrict Friends for anyone who breaks these rules. Report problems to safety@mochibit.app.

6. Health features

Life-link is for fun only. Mochibit is not a medical or fitness device and does not give medical advice.

7. Availability and changes

We work to keep Mochibit running but cannot promise it will always be available or error-free. Friends depends on Apple's iCloud. We may update, change or stop features; if we stop offering Mochibit+, we will tell you in the app.

8. Ownership

Mochibit, its characters, art, music and code belong to ELAQ Limited. These terms do not give you any rights to our trademarks or content beyond using the app.

9. Disclaimer and liability

Mochibit is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid for Mochibit in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer.

10. Apple

These terms are between you and ELAQ Limited, not Apple. Apple is not responsible for Mochibit or its content, has no obligation to provide maintenance or support, and is not responsible for any claims about the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price; Apple has no other warranty obligation. You confirm you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

11. Ending

You can stop using Mochibit at any time by deleting it. We may suspend Friends access if you seriously or repeatedly break these terms.

12. Changes

We may update these terms. We will show the date above and, for significant changes, tell you in the app. Continued use after an update means you accept the revised terms.
